1. Agreement to Terms
By accessing or using the services of Edgemont Electric INC ("Edgemont Electric," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services or website. These Terms apply to all visitors, users, and others who access or use our services.
2. Services Description
Edgemont Electric INC provides residential and commercial electrical services in Naples, FL and Collier County. Our services include but are not limited to:
- Residential electrical wiring and rewiring
- Panel upgrades (100A and 200A)
- EV charger installation
- Smart home wiring
- Generator installation and maintenance (Generac Certified)
- TV mounting and audio/video wiring
- Energy savings and LED upgrades
- Electrical repairs and troubleshooting
- Regular and preventative maintenance
3. Licensing and Insurance
Edgemont Electric INC is a licensed and insured electrical contractor in the State of Florida. We maintain all required licenses, permits, and insurance coverage as mandated by Florida law and local regulations. We comply with all applicable electrical codes (NEC) and safety standards.
4. Quotes and Estimates
Estimates and quotes provided by Edgemont Electric INC are based on the information available at the time of assessment. Final costs may vary based on:
- Site conditions discovered during work
- Changes to the scope of work requested by the client
- Material price fluctuations
- Unforeseen circumstances or complications
All quotes are valid for 30 days unless otherwise specified. Acceptance of a quote constitutes agreement to these Terms and any project-specific terms outlined in the contract.
5. Contracts and Payments
Payment Terms
All work is COD (Cash on Delivery). We accept Visa, Mastercard, Discover, Money Order, and Personal Check. Payment is due upon completion of each job unless otherwise specified in writing.
Florida Construction Law Compliance
All contracts comply with Florida Statute Chapter 713 (Construction Liens) and Chapter 489 (Contracting). Clients will receive all required notices and disclosures as mandated by Florida law.
6. Project Timeline
Project timelines are estimates based on typical conditions. Actual completion dates may be affected by weather, permit delays, material availability, client-requested changes, or unforeseen site conditions. We will make reasonable efforts to complete projects within estimated timeframes and will communicate any delays promptly.
7. Permits and Regulations
Unless otherwise specified in the contract, Edgemont Electric INC will obtain all necessary permits for the contracted work. The client is responsible for ensuring access to the property and compliance with any homeowners association (HOA) requirements or deed restrictions. Additional fees may apply for HOA approval processes or special permit requirements.
8. Warranties and Guarantees
Edgemont Electric INC provides a 1-year warranty on all workmanship. Club Members receive a 2-year warranty automatically. Warranties include:
- Workmanship warranty: As specified in contract
- Material warranties: Per manufacturer specifications
Warranties do not cover damage resulting from misuse, neglect, accidents, natural disasters, or modifications by others. Warranty claims must be submitted in writing within the warranty period.
9. Client Responsibilities
Clients agree to:
- Provide access to the work site during normal business hours
- Ensure utilities are available if required
- Remove or protect personal property in the work area
- Secure pets during work hours
- Make timely decisions on selections and approvals
- Maintain clear communication channels
- Provide timely payments per contract terms
10. Changes and Cancellations
Change Orders
Any changes to the original scope of work must be documented in a written change order signed by both parties. Change orders may affect project timeline and cost.
Cancellation Policy
Cancellation terms are specified in individual contracts. Generally, deposits are non-refundable after work has commenced. Clients are responsible for payment of all work completed and materials ordered or delivered prior to cancellation notice.
11. Limitation of Liability
To the fullest extent permitted by law, Edgemont Electric INC's liability is limited to the total amount paid by the client for the specific project in question. We are not liable for indirect, incidental, consequential, or special damages. This limitation applies to claims based on contract, warranty, negligence, or any other legal theory.
12. Indemnification
Client agrees to indemnify and hold harmless Edgemont Electric INC, its officers, employees, and agents from any claims, damages, or expenses arising from the client's use of our services, violation of these Terms, or infringement of any third-party rights.
13. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Dispute Process
In the event of a dispute, the parties agree to:
- First attempt to resolve the matter through good-faith negotiation
- If negotiation fails, consider mediation before pursuing litigation
- Resolve disputes in the appropriate courts of Florida
14. Insurance and Safety
Edgemont Electric INC maintains comprehensive general liability insurance and workers' compensation insurance as required by Florida law. We comply with all OSHA safety regulations and maintain safe work practices on all job sites. Clients and visitors should stay clear of active work areas for their safety.
15. Intellectual Property
All designs, plans, and materials created by Edgemont Electric INC remain our intellectual property unless otherwise specified in writing. We reserve the right to use photos and descriptions of completed projects for marketing purposes, subject to client approval.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified Terms.
